Samsung will be able to sell its tablet in Australia

The South Korean manufacturer Samsung has managed to get the Federal Court in Sydney to lift the ban on the sale of its Galaxy Tab 10.1 tablet imposed by a judge in October at the request of Apple. The American manufacturer sued Samsung for considering that its tablet violated its patents. Apple has appealed the court's decision, an appeal that must be studied immediately before Samsung can place its tablet in shop windows. The decision is prior to the ruling on the conflict that has not been issued. The judges consider that the commercial life of the tablet is approximately one year and that extending the sales ban would mean "killing" the Galaxy 10.1 in Australia. The most discussed patent refers to the touch screen. The decision will allow Samsung to take advantage of the Christmas campaign.

This episode is not the only one that confronts both companies. In Germany, also at the initiative of Apple, Samsung cannot sell this tablet. Apple maintains that the similarities between its iPad tablet and Samsung's Galaxy 10.1 are too many and has convinced a German court that this is the case. The matter began to be substantiated in August, when the court banned the sale of the Samsung tablet throughout Europe except Holland, for a strictly jurisdictional reason. He later corrected his decision by banning sales only in Germany. The court considers that Samsung's German subsidiary, which has its own legal personality, cannot sell or export the tablet. The other European subsidiaries, however, can market the product in their territory. Samsung argued that Apple had presented false images of the Tab to reinforce the idea that its design was a simple copy, and that the court did not have the power to order a trade blockade throughout the European Union. Apple has open lawsuits for the same reasons in other countries such as France and the United States.

 In the Netherlands, Apple had reported that Samsung violated up to 10 patents it owned with the Galaxy range of smartphones. The judge ultimately agreed with him in one of them and prohibited the sale of three Samsung models. The ban in this country does not affect the tablet.
